Terms of Service

Effective date: July 15, 2026

These Terms of Service (“Terms”) govern your use of the B Botz platform, including the restaurant management dashboard, customer ordering kiosk, and all related services (collectively, the “Service”), operated by B Botz (“we,” “our,” or “us”). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Description of Service

B Botz is a software-as-a-service platform that enables restaurants to accept customer orders via QR code, tablet kiosk, or online link, manage those orders through a live kitchen display, run promotions and loyalty programs, and receive payments directly through their own Stripe account. B Botz is a technology platform only — we are not involved in the preparation, sale, or delivery of food or beverages.

2. Account Registration

To use the Service as a restaurant operator, you must create an account with a valid email address. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. You must be at least 18 years of age and have the legal authority to enter into this agreement on behalf of your business. You agree to provide accurate, current, and complete information and to keep it updated.

3. Free Trial

New restaurant accounts receive a 14-day free trial with full access to all features. No credit card is required to start a trial. At the end of the trial period, access to the paid features of the Service (including order processing) will be suspended unless you activate a paid subscription. We may extend the trial period at our sole discretion.

4. Subscription and Payment

Paid access to the Service is available on a monthly subscription basis at the rates posted on our pricing page (currently $99 CAD/month + HST per location). Pricing is subject to change with 30 days' written notice to active subscribers.

  • Subscriptions are billed monthly in advance.
  • B Botz does not take any commission or transaction fee on customer orders — all payment from customers goes directly from Stripe to your bank account.
  • Subscription fees are non-refundable except where required by applicable law.
  • We reserve the right to suspend your account for non-payment after providing reasonable notice.

5. Stripe and Payments

Payment processing for your customers is facilitated through Stripe. You are responsible for creating and maintaining your own Stripe account and for complying with Stripe's terms of service. B Botz does not hold, transfer, or have access to customer funds at any time. You are solely responsible for issuing refunds, resolving payment disputes, and complying with applicable payment card industry (PCI) standards through your Stripe account.

6. Your Responsibilities

As a restaurant operator, you are solely responsible for:

  • The accuracy of your menu, pricing, allergen information, and dietary labels
  • Compliance with all applicable food safety, health, and business licensing laws
  • Collecting, remitting, and reporting all applicable taxes (HST, GST, PST) to the relevant authority — B Botz collects tax at the rate you configure and passes it directly to your Stripe account; we do not remit taxes on your behalf
  • Fulfilling orders placed through the platform and handling customer complaints
  • Obtaining any required consents from your staff and customers for data processing

7. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of these Terms
  • Attempt to gain unauthorized access to any part of the platform or another restaurant's data
  • Reverse engineer, copy, or create derivative works of the Service
  • Use the Service to process fraudulent transactions or to deceive customers
  • Transmit any content that is defamatory, harmful, or otherwise objectionable

We reserve the right to suspend or terminate accounts that violate these terms without notice.

8. Intellectual Property

The B Botz platform, including its software, design, and trademarks, is owned by us and protected by applicable intellectual property laws. Your use of the Service does not grant you any ownership rights. You retain ownership of your own content (menu items, images, promotional text) that you upload to the platform and grant us a limited licence to display and process it solely to operate the Service on your behalf.

9. Disclaimers

The Service is provided “as is” and “as available” without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components. We are not responsible for the accuracy of menu content, the availability of menu items, or the quality of food or service provided by restaurants using the platform.

10. Limitation of Liability

To the maximum extent permitted by applicable law, B Botz shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of revenue, loss of data, or business interruption, arising out of or related to your use of the Service — even if we have been advised of the possibility of such damages. Our total liability to you for any claim shall not exceed the amount you paid to us in the three months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless B Botz and its officers, employees, and agents from any claims, damages, losses, and expenses (including legal fees) arising out of your use of the Service, your violation of these Terms, or your restaurant's operations including food quality, health incidents, or tax non-compliance.

12. Termination

You may cancel your subscription at any time from your account settings or by contacting us. Cancellation takes effect at the end of the current billing period. We may terminate or suspend your account immediately for breach of these Terms, non-payment, or at our discretion with 30 days' notice. Upon termination, your access to the platform will cease and we will retain your data for 90 days before deletion, during which you may request an export.

13. Governing Law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles. Any dispute arising under these Terms shall be resolved in the courts of Ontario.

14. Changes to These Terms

We may update these Terms from time to time. We will notify active subscribers by email at least 14 days before material changes take effect. Continued use of the Service after the effective date of changes constitutes your acceptance of the updated Terms.
